Terms of Service Addendum – Shared Hosting / Reseller Hosting
1. The Virtual Web Server Internet account and/or related electronic services can only be used for legal purposes under all applicable international, federal, provincial, and municipal laws. The intent of ARYACO is to provide space to serve web documents, not as an off-site storage area for electronic files. Further, the Account Holder agrees not to store, transmit, link to, advertise or make available any images containing pornography. Violations of these or any other provisions of this Agreement may result in termination of the services provided by ARYACO, with or without the grant of a notice or cure period, such notice or cure period to be granted at the sole discretion of ARYACO based upon the severity of the violation. ARYACO reserves the right to refuse service if any of the content within, or any links from, the Account Holder's website is deemed illegal, misleading, or obscene, or is otherwise in breach of ARYACO's then current Acceptable Use Policy, in the sole and absolute opinion of ARYACO. Notwithstanding anything in this Agreement, the content of the Account Holder's website is the sole responsibility of the Account Holder. The Account Holder agrees to indemnify and hold harmless ARYACO from any and all claims, losses, damages, liabilities, judgments, or settlements, including reasonable attorney's fees, costs, and other expenses incurred by ARYACO, (collectively, Claims) related to or in connection with the content of the Account Holder's website. The terms of this Section will survive any termination of this Agreement.
2. The Account Holder agrees not to harm ARYACO, its reputation, computer systems, programming and/or other persons using ARYACO's services. ARYACO reserves the right to select the server for Account Holder's website for best performance. The Account Holder understands that the services provided by ARYACO are provided on a shared server. In order to keep our servers running at optimal levels, any sites running a process that requires more than 8Mb of memory, more than 30 CPU seconds, or uses more than 10% of all available system resources at any time will be required to move up to a dedicated solution or be hosted elsewhere. ARYACO will refund any unused portion of prepaid services. If the Account Holder refuses to comply with this Section, then ARYACO has the right to terminate the services provided to the Account Holder without any refunds of the unused portion prepaid by the Account Holder. The Account Holder agrees to indemnify and hold harmless ARYACO and any other Account Holder from any and all Claims resulting from the Account Holder's use of the services provided by ARYACO The terms of this Section will survive any termination of this Agreement.
3. Backups of new/changed data are made nightly for shared servers. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients' responsibility to maintain local copies of their web content and information. A "Backup/Restore" feature is included with each hosting plan and a client can use this tool to back up their files. If loss of data occurs due to an error of ARYACO, we will attempt to recover the date for no charge to the client. If data loss occurs due to negligence of a client in securing their account or by an action of the client, ARYACO will attempt to recover the data from the most recent archive for a $25.00 fee.
4. Account holder agrees not to provide free services such as free hosting, free subdomains or free email accounts. Account holder agrees not to resell addon domains from their non-reseller hosting account. Account holders found violating this section will be terminated immediately and all payments forfeited.
5. SSH Access. To request SSH access you need to contact support. Upon receipt of SSH request support will ask that the following be provided: Credit Card assigned to account, faxed photo copy of government ID and a verified telephone number. Upon completion of said terms user will be granted Jail access to the system on a provisionary basis any misused of the system will result in access being revoke. The use of php or any other means to circumvent this policy will result in immediate account termination.
6. Disk Usage. 90% or more of your content on your website must be linked from an HTML or similarly coded web page where all content is freely available to the public. Your website consists of web pages of a standard design, essentially HTML based text and graphics. Downloadable files, media, streaming content or any file which consumes more than 500kb of space must not exceed 10% of your total used disk quota. Since ARYACO provides web hosting for the purpose of serving a website at no time shall the account be used for archival, backups or download services.
7. It is a violation for anyone who, including but not limited to, employs posts or programs which consume excessive CPU time or storage space, permits the use of mail services, mail forwarding capabilities, POP accounts, or auto responders other than for their own account; or resale of access to CGI scripts installed on our servers.
8. Adult Material. Because the Internet is a global communication tool, and we have clients from nearly every country in the world it is difficult to dictate what is considered "adult material." However, it is not our function to discriminate against those who choose to utilize adult content or adult related material. This being said, there are still several reasons why ARYACO has been forced to create its no adult sites policy for its virtual server users.
